What is Mediation?
Mediation is usually a voluntary process whereby participants try
to resolve their dispute with the help of a neutral party, often
referred to as a “neutral” or mediator. During mediation, parties
work to reach common ground and resolve their differences.
Typically, there are joint sessions between the parties whereby
the mediator facilitates communication and an understanding of
the underlying problems and issues. There are also independent,
confidential meetings, or caucuses, between the mediator and
each party to discuss the issues further and to explore possible
solutions and terms of settlement.
Mediation does not result in resolution unless both sides are
willing to communicate and are reasonable in their demands or
offers. Settlements are not finalized unless both sides agree.
The mediator does not act as a judge, jury or arbitrator. The
mediator is a neutral party whose goal is to facilitate resolution
between the parties. The mediator does not represent any party
to the dispute or give legal advice during the mediation. Those
involved in a mediation session are encouraged to bring an
attorney, although it is not required.
